A A shall be punished by a fine of KRW 5 million, Defendant B, and C, respectively, by a fine of KRW 7 million.
The above fine is imposed against the Defendants.
Reasons
Criminal facts
1. On December 11, 2014, Defendant A: (a) agreed not to distribute in Guro-gu Seoul Metropolitan Government E, “F” (the model name, 20 parts) and “F” without the consent of the said victim; (b) taken approximately 200 nudic photographs exposed to the said victim’s chest and sound, etc.; and (c) sent approximately 200 nudic photographs to I by e-mail at the Defendant’s house located in Jung-gu Seoul Metropolitan Government G Gara H on December 2014, 2014, using a computer without the said victim’s consent.
Accordingly, the Defendant provided others with photographs taken by the body of the victim who could cause sexual humiliation or shame by using cameras, etc. against his will.
2. On October 12, 2013 and August 27, 2014, Defendant B: (a) agreed not to distribute the victim F, “F,” and “F,” without the consent of the said victim; (b) taken the head of a nudrid photograph photographic white paper with which the said victim’s chest and sound were exposed; and (c) sent, around December 2014, at the Defendant’s house located in J apartment K, J Apartment-si, the Defendant sent, without the consent of the said victim, the head of the nudridic photograph photographic white paper of the said victim to a personal web page designated by the unclaimed recipient of the said victim.
Accordingly, the Defendant provided others with photographs taken by the body of the victim who could cause sexual humiliation or shame by using cameras, etc. against his will.
3. Around August 31, 2014, the Defendant agreed not to distribute the victim “L” (the model name, the 20 unit) and the above victim’s consent, and taken 500 copies of the nudic photograph photographs exposed to the chests and sound parts of the above victim’s chests at the Defendant’s home located in the Seoul Special Metropolitan City, Gwanak-gu, and M, and N, sent 50 copies of the above nudic photograph to O by e-mail without the above victim’s consent, and around November 21, 2014, the Defendant consented to the victim R (the 20 unit) and the above victim’s consent from Q located in the Mapo-gu Seoul Metropolitan Government P.
