A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Defendant,
1. Around June 17, 2014, at the Defendant’s house located in Donsan-gu, a total of 15 times, including posting four copies of a photograph consisting of a female artist’s face on the sex-related photographs of both men and women, chests, and a woman’s sound book exposed by using a computer to “G” on the bulletin board of “F” on the home of the Defendant’s home located in Donsan-gu, Seoul, by using the computer, and then posting a photograph consisting of a female artist’s face on a total of 15 occasions from that time until July 1, 2014;
2. On August 8, 2015, around 15:09, at the Defendant’s home, using a computer, the title “J” of “I” on the Internet website H’s “member margin/Y” bulletin board of the Internet website using the Defendant’s “J”, posted a notice of the Defendant’s gender-related photographs of both men and women, or a photograph of celebrat’s face on a photograph exposed to a woman’s chest and a woman’s sound book, and up to July 1, 2016, up to 378 times in total, as indicated in the attached list of crimes (2);
3. Around June 30, 2016, at the Defendant’s home, as indicated in the foregoing paragraph (1) above, up to 166 times a total of 166 times a synthetic photograph of a celebrtain female artist, including posting a photo of male and female sexual intercourse or a photo exposed to a woman’s chest and a woman’s sound part of a photograph, from the time to July 26, 2016.
As a result, the Defendant, through an information and communications network, openly conducted false information by posting on the Internet a photograph consisting of the face of a famous female artist, such as a sex-related photograph, a chest, and a woman’s sound, etc., of a sexual intercourse with a man and woman, as if the photograph was exposed to the confidential body part of the deceased female artist, such as a sex relation photograph, sound, or chest.
