Reasons
Punishment of the crime
[criminal history] On November 17, 201, the Defendant was sentenced to a summary order of 1.5 million won for a crime of violating road traffic law (driving) at the Seoul Central District Court, which was sentenced to a fine of 3.5 million won for the same crime. On December 24, 2015, the Defendant was sentenced to a fine of 3.5 million won for the same crime.
[Criminal facts]
1. On June 9, 2017, the Defendant was driving a motor vehicle with a blood alcohol content of about 2km from the section of about 0.172% in the direction of the present luminous apartment located in about 95-7, as from the 103rd road, Hongsung-gun, Hongsung-gun, Hongsung-gun, Hongdong, to the front road of the same Eup/Myeon, without obtaining a driver’s license, while under the influence of alcohol content of about 0.172% in the direction of the present 2km.
Ultimately, the Defendant, who violated Article 44(1) of the Road Traffic Act not less than twice, driven a motor vehicle without obtaining a driver’s license under the influence of alcohol in violation of the said provision.
2. On June 9, 2017, the Defendant violated the Road Traffic Act driving the said car on or around 04:30, and driving the front of the said luminous apartment road on or around 10:0,000, the front of the said luminous apartment road was driven at about 60km a speed, depending on one of the two lanes, from the string side to the string new distance.
At the time, the road was at night and at the left side, so there was a duty of care to prevent accidents in advance by reducing the speed of the driver of the vehicle and by safely manipulating the steering direction and brakes and safely.
Nevertheless, the defendant, as stated in the above 1. paragraph, neglected to drive a motor vehicle without a driver's license and proceeds therefrom without the driver's license, caused the part on the left side of the DNA cargo vehicle, which is the victim C, parked at the edge of the road on the front side of the running direction of the defendant, to be the front part of the above motor vehicle, and caused the above cargo vehicle to be pushed ahead to the right side of the motor vehicle, and the left side of the motor vehicle is to be front.
