1. The defendant,
A. As to the Plaintiff A’s KRW 11,140,00 and KRW 340,00 among them, the amount of KRW 11,20,00 shall be from December 31, 2009 to KRW 1,20,00.
Reasons
1. Basic facts
A. On September 6, 1952, 1952, I received the order of the French Military Merit on September 7, 1953, 1953, after having been killed and wounded by 1,2, and 3 members of the enemy army in the 625 War. On April 7, 1953, I received the order of the French Military Merit on July 28, 1953.
B. 1) Family relationship and death, etc. of I (1) A married with the Plaintiff B, M students C, N students Plaintiff D, O students Plaintiff E, P students F, Q students G, and R students H, respectively. (2) Plaintiff B married with the Plaintiff in around 1975.
3) The I died on April 14, 1982 (hereinafter “the deceased”).
4) The Plaintiff D married in 1986 and went out of Korea.
C. 1) The Act on the Honorable Treatment, etc. of Persons of Distinguished Services to the State (hereinafter “Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State”) was enacted on November 1, 1961 and enforced on January 1, 1985 and enacted on January 2, 1984.
(1) From 1955 to 1997, the Army Headquarters under the Defendant’s control confirmed that “the 625 Order of Military Merit was awarded to the deceased.” The Order of Military Merit was delivered by mistake to the deceased, rank and service number, resident registration number, address, etc., and the above person becomes qualified as a person of distinguished service to the State under the Act on Persons of Distinguished Service to the State, by filing an application for registration of a person of distinguished service to the State. (2) On the ground that the above person died in around 2012, the deceased person’s bereaved family member was laid to rest in the National Cemetery.
