Reasons
Punishment of the crime
On August 16, 2001, the Defendant was sentenced to one year and four months of imprisonment for fraud at the Jeju District Court on August 16, 2001, and on July 14, 2002, the same criminal records were more than ten times in addition to the completion of the enforcement of the sentence in the Jeju Correctional Institution.
Criminal facts
1. On March 18, 2005, the Defendant, at the C office of the Defendant’s operation located in Gwangju Northern-gu, Gwangju Northern-gu, as if the Defendant had refited a large number of real estate properties, such as a dry field, in Jeju-do, and provided the victim D with money for about 37 years in daily distribution business. The Defendant attempted to ship a sealed farmer in Jeju-do. In order to harvest smuggling, the Defendant was able to trust and make an investment that is less than 25 million won and to return tights by packaging, packaging, shipping 45 million won under the pretext of the purchase price of stuffs. In other words, the Defendant received KRW 25 million from the victim.
However, in fact, the Defendant had a total of KRW 200 million debt without any particular property or income, and even C had operated at the time reported the enemy, and the Jeju-do did not have a close agricultural business. Therefore, even if the Defendant received money from the victim, he did not have any intent or ability to repay the money.
The Defendant, by deceiving the victim as such, received from the victim a sum of KRW 25 million as an investment loan from the victim, that is,, he/she obtained from the victim.
2. The Defendant, at the above C office on September 1, 2005, committed as if he had a large amount of money in Jeju-do, to the victim E, saying, “The Defendant would have a large amount of money lent money for the purchase of gambling in Jeju-do and shipped it to the joint wholesale market. If 2 million won remains, 18 million won of profit remains if she would have a large amount of money, and she would have a large amount of profit if she lent money for the purchase of gambling.”
