The pronouncement of sentence shall be suspended.

Seized evidence subparagraph 1 shall be forfeited from the accused.

Punishment of the crime

From March 15, 2013, the Defendant, from March 15, 2013 to September 1, 2013, is operating a place of business with the main body, monitors, chairs, etc. of computers, etc.

피고인은 2013. 03. 25. 17:20경 위 업소 밀실에 음란물이 저장된 메인컴퓨터 1대와 9개의 밀실에 설치된 컴퓨터 9대를 서로 연결하여 놓은 통신망 등을 설치 한 다음 메인 컴퓨터에 인터넷 음란사이트로[D]부터 내려받은 남녀간의 성기가 들어난 성관계가 노골적으로 표현된 속칭 ‘포르노물’인 ‘스와ㅍ 변강쇠마님1’등을 설치해놓고 손님 E(남,31세)에게 5,000원을 받고 관람하게 하는 등, 동업소를 찾은 불특정 다수 손님들에게 시간당 5,000원의 이용료를 받고 컴퓨터 바탕화면에 있는 ‘Tt의 0활력충전’ 아이콘을 통하여 음란한 동영상을 볼 수 있도록 진열, 보관한 것이다.
