The defendant is not guilty. The summary of the judgment against the defendant shall be published.

Reasons

1. The Defendant is a person who conducts a public bath business with the trade name “D” in Yongsan-gu Seoul Metropolitan Government.

No person who operates a public bath business which is a public morals business office of the 2014 High 1040's case shall allow any person to view or peruse obscene documents, drawings, motion pictures, music records, video products, and other obscene materials, or display or keep them for the purpose of distribution, sale, lending, viewing or perusal.

Nevertheless, at around 23:00 on October 18, 2013, the Defendant installed a computer body and television monitor at the third floor resting room of the above D, and stored obscene videos with a face-to-face and a face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face

Nevertheless, at around 21:40 on March 18, 2014, the Defendant carried on business with eight partitionss and mixed Seas in the room and each room. On the left side of the entrance, the Defendant violated the code of practice of a person with the same sex E (the age of 48) and Vietnam’s nationality F (the age of 20), who is aware that two male persons have sexual intercourse with their own body, by allowing them to have obscene acts, even though they are aware that they have sexual intercourse, the Defendant violated the code of practice of a person with the amusement business affecting the public morals.

2. Determination A.

Article 10(2) and Article 3 subparag. 3(b) of the Act on the Regulation of Amusement Businesses Affecting Public Morals case is established where the amusement business operator allows customers to view and peruse obscene materials at the amusement business place, and any specific act in accordance with the principle of no crime without the law is allowed to view and peruse obscene materials.
