Defendant

A is a person who was going to be a candidate for D military units in the 7th simultaneous local elections held on June 13, 2018, and Defendant B and Defendant C are married couple, who support Defendant A and carried out an election campaign.

1. No defendant A National Assembly member, local council member, head of a local government, representative of a political party, candidate (including a person intending to become a candidate) and his/her spouse shall make contributions to persons in the constituency concerned, or agencies, organizations, or facilities, or persons having relations with residents in the constituency concerned, or institutions, organizations, or facilities, even if they are outside the constituency concerned;

A. The Defendant, who violated the restriction on contribution act to E, was a candidate for the above D military election.

On December 28, 2017, from 14:16 to 15:28, B visited E’s house located in the former North F along with B, and provided E, a electoral resident, with approximately KRW 30,000 of the market price and KRW 10kg 1.

B. A violation of restriction on contribution to G (a name) is committed by the Defendant to become a candidate for the above D military election.

On January 1, 2018, at around 14:00, visited G operation G in the former North H, and provided a white bag containing KRW 200,000 in cash with G’s mother’s nursing expenses to G’s spouseJ (one person) who is a electoral citizen.

As a result, the defendant was a candidate for the election of the head of local government, and made a contribution to a person in the election district.

2. No person who is a National Assembly member, local council member, the head of a local government, the representative of a political party, or a candidate (including a person intending to become a candidate) and his/her spouse, or any institution, organization or facilities, or any person having relations with residents in the constituency concerned even if they are outside the relevant election district, or any institution, organization or facility, or donation to such institution, organization or facility, shall promise, recommend, mediate or demand such act;

Nevertheless, on December 28, 2017, the Defendant sought to become a candidate for the election of D military units on or around December 28, 2017.
