A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Indecent acts by compulsion;

가. 피고인은 2015. 1. 3. 00:30경 계룡시에 있는 피해자 D(여, 48세)이 운영하는 유흥주점에 손님으로 찾아가 위 유흥주점 3번 방에서 여자 도우미를 불렀으나 마음에 들지 않는다는 이유로 업주인 피해자에게 “너 씨발 년아, 니가 놀아, 개년아”라고 말하였는데 피해자가 “저는 사장입니다. 신랑이 있습니다.”라고 거절하자 “씨발 년아, 내가 이 동네 깡팬데, 너 죽고 싶냐.”라고 협박하며 왼팔로 피해자의 목을 눌러 소파에 넘어트린 후 오른손으로 피해자의 하의를 벗기고 음부와 가슴을 수차례 만지는 등 피해자를 강제로 추행하였다.

B.
