A defendant shall be punished by imprisonment for six months.

Punishment of the crime

In short, the joint case was cultivated according to the order of time, not the case number order, and the part of the facts charged was legally adopted and investigated by this court to the extent that it does not interfere with the defendant's exercise of his/her right to defense.

1. Highest 2016 420

A. On June 24, 2015, in front of the D convenience store located in Gwangjuyang-si, around 19:00, the Defendant: (a) did not have money during the number; and (b) did not have any intent or ability to pay the taxi fee even if using the victim E (54) taxi; and (c) took the victim’s F taxi into the victim’s operation, he/she did not pay the taxi fee; and (d) did not have the victim operate again via the H hospital located in G at such time, and did not pay a approximately KRW 50,000 of the taxi fee, and thereby, he/she acquired property benefits equivalent to the amount of the taxi fee, from that time to September 16, 2015.

B. On November 8, 2015, the Defendant: (a) acquired one copy of a debit card (L) issued by the Daegu Bank in the name of the victim K (44 years old) who was lost due to the victim K (44 years old)’s departure from the vehicle on the street in front of the “J cafeteria” located in Gwangju-si around 21:40 on November 8, 2015.

Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim and embezzled it on his own idea.

(1) On November 21, 2015, the Defendant purchased goods equivalent to KRW 85,000,000, from the N convenience stores located in Gwangju-si M around November 21:47, 2015, and from the purchase of goods equivalent to KRW 85,00,00, such as tobacco 20, as stated in the above 2. The Defendant is acting as a legitimate holder of the debit card of the Daegu Bank under the name of K, Daegu Bank. The Defendant used 85,00,000 for the settlement of the price by the said debit card and used the amount equivalent to the amount.
