A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On January 27, 2016, the Defendant sentenced ten months to imprisonment with prison labor at the Changwon District Court for fraud, etc., and completed the execution of the sentence in the Changwon Prison on June 2, 2016.
1. Fraud;
A. C. On July 27, 2016, the Defendant: (a) around 14:05, at the K cafeteria located in the J of Kimhae-si operated by the victim I; (b) on the basis of the fact, the Defendant was committed as if he did not have any intent or ability to pay the food cost, and was ordered to do so in a tight manner; and (c) the Defendant was issued by the victim a mispercing that amounting to KRW 5,00 in the market price.
2. On July 27, 2016, at around 17:50, the Defendant damaged public goods: (a) was arrested in flagrant offender under suspicion of fraud as stated in paragraph (1)(c) of Article 1; (b) and was detained in a three room of the cell of the Kimhae Police Station in 2307 as Kimhae-si, Kimhae-si; (c) took a bath to “Cropic spacks, spacks, spacks, and spacks,” and used by public offices by removing a cry materials installed on the wall in a double hand, thereby destroying the market value of 45.
