Defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

[2016 Highest 913] The Defendant, from July 2013 to Pyeongtaek-si B, was in charge of joining the mobile phone of D, E, and F while operating the mutual mobile phone sales store of “C” from Pyeongtaek-si B.

The defendant shall file an application for joining of foreigners who have joined a mobile phone through the above mobile phone sales store and the summary of termination thereof.

With the picture that he/she retains customer information, such as the identification card received by the audience, he/she has arbitrarily subscribed to the mobile phone in the name of foreigners, acquired a mobile phone subscription subsidy from the telecommunications company, and taken the mind that he/she arbitrarily sells the mobile phone device.

1. Around May 1, 2015, the Defendant forged private document: (a) using the personal information of G, which had previously applied for membership of the mobile phone through the Defendant’s agency; and (b) using the personal information of G, which had previously been applied for membership of the mobile phone; (c) notwithstanding the fact that the said nominal owner had not been delegated the authority to join the mobile phone; (d) without authority, in the name column “G” and the telephone number column of D’s “H service new contract” type kept in the said agency without authority for the purpose of exercising the said authority; and (e) written “G” into the name column and the telephone number column; and (e) voluntarily signed on the name following

From April 3, 2015 to August 15, 2015, the Defendant, including this, forged the application for the entry of a cellphone in 61 in total, as indicated in the same manner, excluding Attached Nos. 34 and 39 in the list of crimes.

Accordingly, for the purpose of uttering, the Defendant forged the Chapter 61 of the New Contract for H Services in the name of 62 persons, such as G, which is a private document related to rights and obligations (in the name of J two pages).

2. The Defendant at the time and place specified in paragraph (1) shall send an application for subscription under the aforementioned forged G name to K, a person in charge of opening DNA mobile phones, who is aware of the forgery, as if it were a document duly formed.
