A defendant shall be punished by imprisonment for two years.

Punishment of the crime

[2014 Highest 4819] The Defendant, who runs a mobile phone sales store in the name of “D” in Daegu Northern-gu C, had been able to arbitrarily open a new mobile phone without the consent of the nominal owner and raise the result of subscription.

1. Crimes around November 12, 2013:

A. On November 12, 2013, the Defendant forged private document: (a) around November 12, 2013, the Defendant laid off “F” as indicated in the column of serial numbers of the application for mobile phone entry written by E in the foregoing D with the revised amount; and (b) covered “G” above; and (c) drafted an application for mobile phone entry separate from the existing application for mobile phone entry in the same manner as “I” written in the core number column.

Accordingly, for the purpose of uttering, the Defendant forged a copy of the mobile phone entry application in the name of E, a private document related to rights and obligations.

B. The Defendant, at the time and place of the foregoing paragraph, sent an application for subscription to a forged mobile phone as if it were a document duly formed, to an employee in the name of J, who was aware of the forgery.

2. Crimes around November 20, 2013:

A. On November 20, 2013, the Defendant forged private document: (a) obtained a driver’s license from the said L to move the KT mobile phone that was opened in the name of his mother via K to LG, which is another radio operator; (b) stated “L”, “N”, “N”, “N”, “N”, “L” in the application date column, and “L” in the applicant column.

Accordingly, for the purpose of uttering, the Defendant forged a new application for joining a mobile phone in the name of L, which is a private document related to rights and obligations.

B. The Defendant at the time, place, and place of the above paragraph (1) above, is not aware of the forgery, as above, a staff in the name of the SKT Telecommunication Officer.
