The 1-A through D of the judgment of the defendant and the 2-A-D of the judgment of the defendant shall be punished by imprisonment with prison labor for one year, and the 1-e of the judgment.
Reasons
Punishment of the crime
[Criminal Power] On August 27, 2015, the Defendant was sentenced to 8 months of imprisonment with prison labor for a violation of the National Sports Promotion Act (Gambling, etc.) at the Gwangju District Court and 3 years of suspended execution, and the said judgment became final and conclusive on September 4, 2015.
【Criminal Facts】
The defendant is not a person handling narcotics.
1. Medication of phiphones;
A. On October 2014, the Defendant, along with C, injected approximately 0.03g of psychotropic drugs, into a single-use injection machine, and injected them with water into the following arms.
B. On November 2014, the Defendant: (a) inserted approximately 0.03g of his own philopon into a single-use safeguard unit in Gwangju-gu, Seo-gu; and (b) injected them into the following arms, melting them into a single-use safeguard unit; and (c) administered them.
C. On February 2, 2015, the Defendant injected approximately 0.05g of philophonephones into the Emburine room located in Gwangju-gu, Gwangju-gu, with G, for a single-use injection, and injected them into the following arms.
around March 2015, the Defendant injected approximately 0.03 g of oponon-phones with C in a single-use injection machine, and melted with water into the following arms in around March 2015.
E. On October 11, 2015, the Defendant injected approximately 0.03g of his own philopon into a single-use injection machine along with I, and injected them into the following arms.
2. Purchasing phiphones;
A. On March 4, 2015, the Defendant: (a) purchased 0.7g of philopon from C; (b) transferred KRW 5.30,000 to the account used by C (CFJ) around March 4, 2015; and (c) purchased approximately 0.7g of philopon from C on the road side of the BFF, Seo-gu, Gwangju on the same day.
B. On May 24, 2015, the Defendant: (a) transferred KRW 3.60,000 to the account used by C (Seoul AFFJ) around May 24, 2015; and (b) from C on the side of the road on the Han-gu, Seo-gu, Gwangju.
