1. The defendant shall pay 41,376,125 won to the plaintiff and 20% per annum from April 15, 2020 to the day of complete payment.
Reasons
1. Indication of claim;
A. From May 1, 2017 to March 31, 2020, the Plaintiff was employed by the Defendant and retired from office as the employee. From August 2019 to March 2020, the Plaintiff was not paid KRW 41,376,125 in the aggregate of KRW 3.8 months’ wages and retirement allowances for the period from August 2019 to March 2020.
B. Thus, the defendant is obligated to pay to the plaintiff 41,376,125 won with 20% interest per annum from April 15, 2020 to the day of full payment pursuant to Articles 36, 37(1) of the Labor Standards Act and Article 17 of the Enforcement Decree of the same Act.
2. Article 208 (3) 1 and Article 257 of the Civil Procedure Act of the applicable provisions of Acts;
