Defendant shall be punished by a fine of KRW 7,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[2016 Highest 3781] On September 12, 2016, the Defendant ordered food as if he did not have the intent or ability to pay the price even if he was provided with food from the victim E, since he did not possess the wall, card, cash, etc. at the time.

Accordingly, the Defendant, by deceiving the victim as above, received a total amount of 12,000 won, such as a 1studio, 4,000 won, and a 12,000 won, from the victim.

[2016 Highest 4436]

1. Around 22:00 on September 15, 2016, the Defendant issued an order for food as if he would pay the amount, even though he did not have the card at the time and only possessed cash 2,000 won, and he did not have the intent or ability to pay the amount even if he was supplied with food from the victim.

Accordingly, the Defendant, by deceiving the victim as above, received food equivalent to KRW 27,500,00 in total from the victim, which is equivalent to KRW 24,00,00.

2. The Defendant obstructed the victim’s restaurant business by force for about 15 minutes, such as: (a) the Defendant, at the time and place specified in paragraph (1) of this Article, without any justifiable reason, was unable to enter the victim’s restaurant business by avoiding disturbance, such as: (b) the booming customer and the victim G of the said H’s business without any reason; (c) the booming customer with a view to drinking; and (d) making the customer entering the said place booms;

From September 4, 2016 to 06:00 on the same day, the Defendant interfered with his/her business, without any reason, prevents the Defendant from entering the place of a disturbance, such as provoking time to other customers, and having other customers get a guest, and intending to enter the place of a view, by force.
