1. The defendant is based on the transfer on January 12, 1970 to the plaintiff of each real estate listed in the separate sheet.
Reasons
1. Facts of recognition;
A. (1) The Geumsung Repair Association was established on March 20, 1950 under the Joseon Repair Association Order (established on July 21, 1917 by Ordinance No. 2, which was repealed on January 21, 1962), and was merged into the Geumsan Repair Association on December 7, 1961, and (2) pursuant to paragraph (6) of the Addenda of the former Land Improvement Project Act (established on December 31, 1961 by Act No. 948, Jan. 12, 1970, and repealed by Act No. 21999, Dec. 29, 1995; and (3) The previous Agricultural Community Improvement Promotion Act was amended by the title of the Geumsan City Improvement Association on December 27, 197, and Article 2 of the Addenda of the former Agricultural Community Improvement Project Act (amended by Ordinance No. 2199, Dec. 29, 199).
④ The Geumsan Farmland Improvement Association is dissolved by the execution of the former Agricultural and Rural Infrastructure Corporation and Farmland Management Fund Act (Act No. 5759, Feb. 5, 1999); the Korea Agricultural and Rural Infrastructure Corporation established on Jan. 1, 200 succeeded to the rights and obligations of the Geumsan Farmland Improvement Association under Article 9 of the above Act, including the rights and obligations of the Korea Agricultural and Rural Community Corporation and Farmland Management Fund (Act No. 7775, Dec. 29, 2005).
B. The real estate listed in the annexed list Nos. 1 through 10 is incorporated into a new reservoir completed by the Geumsung Repair Association in 1961, the real estate listed in the annexed list Nos. 11 through 13 is the forest reservoir completed in 1956, the forest reservoir completed in 1956, the real estate listed in the annexed table Nos. 11 through 14 is incorporated into a land for the forest reservoir which was completed in 1958, and the land listed in the annexed table Nos. 15 through 17, and is used as a site for the above land until now.
C. After that, the defendant on January 12, 1970, under the former Agricultural Community Modernization Promotion Act.
