Reasons
Punishment of the crime
The defendant purchased the victim B's driver's license obtained in an influencous manner, which was directed to his daily life due to his failure of business, etc., using his personal information in B, and thought that he will use the credit card.
1. Crimes related to the purchase of mobile phones B;
A. (1) On March 11, 2014, the Defendant forged a private document: (a) purchased a mobile phone sales agent located in Busan District of Busan District on March 11, 2014 with only one unit of “LGG G-pro-2” mobile phone in the name of B and subscribed to D mobile phone service under the name of B by taking the action of B; (b) the “new service contract”, “contract for installment sales of a device”, “application for subscription to a fee discount system” in the “name”, “resident registration number E”, “applicant for each site,” “B” and “B” and signed next to that.
Accordingly, for the purpose of uttering, the Defendant forged “a new service contract”, “a terminal installment contract”, and “a written application for subscription to the fee rate discount system” under the name of private document B, which is a private document on rights and obligations.
(2) On the same day, at the same place as above (1) and at the same time, the Defendant: (a) presented the forged service contract to an employee of the foregoing mobile phone sales agency who is aware of the forgery; (b) presented the forged service contract; (c) the “written application for subscription to the fee rate discount scheme; and (d) presented the same as the genuine written application.
B. On December 11, 2015, the Defendant: (a) committed an act committed on the part of December 11, 2015; (b) when the LGG G-pro-pro-pro-2 mobile phones used in the opening of private electromagnetic records was worn out, the Defendant was willing to purchase a mobile phone again in the name of B; (c) had access to the Internet sales site using a computer at the “G” office located in the Yangsan City F on December 1, 2015; and (d) had access to the Internet sales site using a computer; and (e) had access to the unit principal of KRW 1,130,800.
