The judgment of the court below is reversed.
The defendant shall be innocent.
Reasons
1. Summary of the facts charged
A. On May 2009, the Defendant forged private document: (a) indicated the “Incheon-gu D102”, “2,00,000 won in the deposit column; (b) 320,000 won in the rent column; and (c) indicated the “F, G, and E” in the lessee column; and (d) forged one copy of the real estate lease contract in the name of F, G, and E (hereinafter “instant contract”) in the name of E, a private document on the rights and obligations of E, signed by E, under the name of E, with the intention of exercising the claim for rent against E.
B. Around November 17, 2011, the Defendant filed a claim for rent against E at the Incheon District District Court civil petition office located in 163 Doo-ro 17, Nam-gu, Incheon, Nam-gu, Incheon, and issued the instant contract to the public official in charge along with the written complaint.
(2) On May 17, 2012, the Defendant issued a reply to the claim objection lawsuit filed by the public service center of the relevant Incheon District Court, and to the public official in charge, attaching the instant contract (1) to the response to the claim objection lawsuit filed by E.
C. Around November 17, 2011, the Defendant filed a lawsuit with the public service center of the relevant Incheon District Court (hereinafter “Seoul District Court”) to file a claim for rent payment against the victim E along with the instant contract. However, the Defendant was a lessee of the Incheon District Court (hereinafter “instant contract”) around December 1, 2008. Nevertheless, the Defendant filed the said lawsuit and won the victim by the final decision of performance recommendation on December 22, 201. (2) On May 17, 2012, the Defendant was also the public service center of the relevant Incheon District Court, the public service center of the public service center of the Incheon District Court, and the Incheon District Court 201Da35971, which was filed to dispute the final decision of performance recommendation by the victim E, accompanied by the instant contract ① the response.
