A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2019. 1. 21. 23:50경 평택시에 있는 B역 3층 전철 게이트 앞에서, B역 소속 사회복무요원인 피해자 C(23세)에게 서울로 어떻게 가는지 질문하였다가 위 C가 놀리듯이 알려준다는 생각에 화가 나, C에게 욕설을 하며 C의 얼굴과 왼쪽 눈을 손으로 때리고 낭심 부위를 발로 3회 걷어찼다.

피고인은 B역 역무원들인 피해자 D(39세)과 E(55세)이 위와 같은 피고인의 행위를 제지하자, D에게 욕설을 하며 손으로 목을 잡고 발로 복부를 2회 걷어차고 손바닥으로 손을 때리고, E에게 욕설을 하면서 손으로 목을 잡고 손으로 어깨를 잡아당기고 발로 무릎을 걷어찼다.
