A defendant shall be punished by imprisonment for not less than eight months.

The defendant is the defendant to K who is an applicant for compensation, 214,00 won, and the applicant for compensation.

[2014 Highest 1587] On May 8, 2014, the Defendant posted a letter to the effect that a cell phone is displayed on the Internet medium trading website Niberian bulletin board, and send a cell phone to the victim M who made a report on this letter if he/she sent KRW 1.50,000 to the victim M who made a call.

However, since the defendant did not have a mobile phone, there was no intention or ability to send a mobile phone even if he receives money from the victim.

The Defendant received 150,000 won from the victim, i.e., remittance from the victim’s bank account in the name of the Defendant, and received 50,000 won in total from the victims through 50 times from April 29, 2014 to July 26, 2014, as indicated in the annexed Crime List.

On May 24, 2014, the Defendant posted a text message stating that “The victim N is 60,000 won with a good cell phone size” on the Internet in the website “Syna website” column at the location of Busan, the Defendant sent a text message to the victim’s cell phone, and carried out two mobile phones at KRW 60,000,000.

However, since the defendant did not have a mobile phone, there was no intention or ability to send a mobile phone even if he receives money from the victim.

The Defendant, by deceiving the victim as such, received 60,00 won from the victim to the bank account in the name of the Defendant in the name of the mobile phone price on the same day.

2. On July 28, 2014, the Defendant posted a text message stating that “I purchase 3,000 won via a 15,000 won from the cell phone of the victim,” at a place in Daejeon, Daejeon, the Defendant sent a text message to “I purchase 2G 2G 2G 200,” and carried out as if I were to sell the said goods at KRW 15,000.
