A defendant shall be punished by imprisonment for two years.

The defendant is an applicant for compensation, who is an applicant for compensation, of KRW 1,200,00.

Punishment of the crime

"2016 Highest 1613"

1. On April 12, 2016, the Defendant, at the PC room where it is impossible to know the trade name in the Southern-gu Busan metropolitan area, on April 12, 2016, posted a false statement stating that “The victim G wishes to purchase “LG V10” cell phone numbers after accessing the NAV,” and that “The victim G want to sell the cell phone machine to the victim. It is residing in Jeju-do and will send the cell phone number to the phone.”

However, there was no intention or ability to send the above mobile phone to the victim because the victim did not have a mobile phone device.

The Defendant received 310,000 won from the victim as the price of goods from the victim to the Jeju Bank account (Account Number H) in the name of the Defendant, and received the total sum of 9,230,000 won through the same method over 30 times from around that time to June 14, 2016, such as the list of crimes No. 1 in attached Table 1.

2. On June 26, 2016, at around 20:31, the Defendant sent a false statement to the NA, stating that “A purchases smartphone V10” to the victim, and that “A will sell a smartphone. 100,000 won to the bank J account in the name of A, the Defendant would send a smartphone on the face of the transfer to the bank J account in the name of A.

However, the defendant did not have a cell phone so that he did not have any intention or ability to send a cell phone to the victim.

The Defendant, as such, by deceiving the victim, received KRW 100,000 from the victim on the same day, and took over KRW 59,000 from the victim to July 18, 2016, such as the statement in the list of crimes in attached Form 2, from around that time.

3. On March 26, 2016, the Defendant, at around 22:15, connected to the Defendant’s house located in Seo-gu Busan, Seo-gu, that “I sell Kamerman G10.”
