A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On November 11, 2014, the Defendant posted a false statement to the effect that “the Defendant would sell a gallon No. 4 mobile phone at a gallon site” after having access to the Internet NAVER’s website at an irregular place, and reported that false statement to the effect that “the Defendant would send a cell phone to gallon C who first remitted 460,000 won to gallon.”

However, the defendant did not have the above mobile phone, so there was no intention or ability to send the above mobile phone to the victim.

The Defendant received 360,000 won from the victim as the price for the goods on the same day from the victim to the single bank account under the name of the Defendant.

2. On December 4, 2014, the Defendant posted a false statement to the effect that “I will sell a gallon 4 mobile phone at a gallonian site,” and that “I will send a cell phone at home if I first transfer 430,000 won to D.”

However, the defendant did not have the above mobile phone, so there was no intention or ability to send the above mobile phone to the victim.

The Defendant received 400,000 won from the victim to the bank account in the name of E as the price for goods on the same day, and received 30,000 won on October 10 of the same month from the victim to the one bank account in the name of the Defendant.

3. On December 30, 2014, the Defendant made a false statement to the effect that “the Defendant would sell a gallonno-4 mobile phone at a gallon-based thallon-based thallon-based thallon-based thallon-based thallon-based thallon-based thallon-based thallon-based thallon-based thallon-based thallon-based thallon-based stallon-based stallon-based stallon-based

However, the defendant did not have the above mobile phone, so there was no intention or ability to send the above mobile phone to the victim.
