Reasons
Punishment of the crime
[criminal history] On September 25, 2015, the Defendant received a summary order of KRW 1,50,000 as a fine for a violation of road traffic law (dacting driving) from the Youngcheon District Court’s Young-gu branch on September 25, 2015. On January 29, 2016, the Defendant was sentenced to a fine of KRW 5 million due to the same crime in the same court.
[Criminal facts]
1. On July 6, 2017, the Defendant driven BM5 car from around 380 meters in a section of around 380 meters to the road prior to the same City/Do 5 CU convenience store, under the influence of alcohol leveling 0.162% among blood transfusion around 23:00 on July 6, 2017.
2. Crimes committed on August 6, 2017;
A. On August 6, 2017, the Defendant was under the influence of alcohol level of 0.124% in blood on August 6, 2017, the Defendant driving BM5 cars at a section of approximately 50 meters from the front day of the Yongsan-gu, Yongsan-gu, Busan to the front day of the same Sinsan-gu, U.S.-si, under the influence of alcohol level of 0.124%.
B. The Defendant: (a) stated the forgery of a private document; (b) at the time and place specified in Article 2-2-A; (c) stated that the Defendant was required to sign a report on the circumstances of the driver working at the police station E-gu Busan Central Police Agency, Busan, U.S., which was under the influence of drinking at the time and place; (d) stated that the Defendant was “G” whose birth was the Defendant’s birth name; and (e) signed the said report in the name column; and (e) delivered the said report to the head of the police station after pretending that the Defendant was G.
Accordingly, for the purpose of exercising the right, the Defendant forged and used a false statement report on the situation of the driver in the name of G on fact certification.

The Defendant, such as electronic records, etc., and electronic records of the above writers, was requested to sign the police terminal F on the screen of the police terminal (PDA), at the time and place specified in subparagraph 2-b.
