Reasons
Punishment of the crime
[Criminal Power] On December 8, 2016, the Defendant was sentenced to 10 months of imprisonment for a violation of the Act on the Control of Narcotics, Etc. at the Seoul Central District Court on February 18, 2018 and completed the execution of the sentence.
【Criminal Facts】
The Defendant, who is not a person handling narcotics, did not deal with psychotropic drugs such as the sale, possession, administration, etc. of psychotropic drugs (hereinafter referred to as “clopon”), but dealt with copon as follows.
1. On July 2018, at the end of 20:00, the Defendant: (a) called “C” to sell phiphones; and (b) purchased 0.7g of phiphones by linking the sales volume of phiphones with “C”; (c) wired 300,000 won in cash to the c account designated by the said sales volume at the 1st cash withdrawal at the north-gu, the same day; (d) received the address of phiphones from the said sales volume through “C”; and (e) purchased 0.7g of phiphones with a single house in H located in the south-Gu, Nam-gu, Y. G at the end of 201:0 on the following day.
2. Medication of phiphones.
A. At around 10:00 on August 9, 2018, the Defendant administered at the Defendant’s residential toilet located in the North-gu I apartment J, North-gu, Mapo-si, in a way of inserting 0.05gg of the penphone 0.7g purchased as described in the foregoing paragraph (1) into a single-use injection instrument, dilution with water, and injection into his/her arms blood transfusion.
B. At around 06:00 on September 2, 2018, the Defendant administered 0.05g of philopon 0.7g, purchased as described in the foregoing paragraph (1), in a single-use injection machine, and dilution with water, in a way of injection into his/her arms.
C. At around 05:00 on September 9, 2018, the Defendant administered 0.05g of philopon 0.7g, purchased as described in the foregoing paragraph (1), in a single-use injection machine, and dilution with water, in a way of injection into his/her arms.
