A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 11:45 on April 20, 2013, the Defendant violated the Road Traffic Act (refluence of the noise measurement) and the Defendant avoided the alcohol measurement by means of inserting the alcohol measuring instruments in a manner of making it difficult to recognize that he was driven under the influence of alcohol, such as taking a vehicle under a stop in the course of a traffic accident after being driven by a vehicle under the influence of alcohol in front of 687, Dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong

Accordingly, the defendant did not comply with the sobreath test of a police officer as a person who has a considerable reason to recognize that he is under the influence of alcohol.

2. On April 20, 2013, at around 13:12 on April 20, 2013, the Defendant damaged public goods, the head of the Suwon Police Station’s Office located in Suwon-si, 911, in order to take a drinking test as set forth in the above paragraph (1), and went out of the said office after receiving a recommendation to return home to police officers, and was set off with a locking device in order to re-enter the above office, the Defendant was accompanied by 260,000 won for repairing the locking device.

In this respect, entrance locking devices used by public offices were damaged.

3. On April 20, 2013, from around 12:20 to around 13:22, the Defendant: (a) expressed to police officers at the Suwon Police Station’s Traffic Investigation Office located in the 911-dong, Suwon Police Station located in the Gyeonggi-si, Gyeonggi-si; (b) expressed to “the bit of bit of bitoms, bit of bitoms, bit of bitoms,” and assaulted the Defendant at one time at the seat of the police officer at the place of the Dongwon Police Station’s traffic Investigation Office, namely, “the bit of bit of bits, bit of bits, bits,” and walked off the partitions inside the said office for about one hour.
