Reasons
Punishment of the crime
1. On June 19, 2015, the Defendant, at around 23:30 on June 19, 2015, found one national physical fitness card lost by the victim B at the street, before the entrance of the market south-dong located in Yangsan-si.
The Defendant, without taking necessary procedures such as returning the acquired property to the victim, embezzled the property that he/she thought to have, and has taken, lost from the possession of the victim.
2. Specialized credit finance business and fraud;
A. On June 20, 2015, the Defendant: (a) purchased goods equivalent to KRW 5,100 at the D convenience store located in Yangsan City, at the place of Yangsan City, and had the victim B, who acquired, present the Victim B’s national physical fitness card, and made a false signature thereon; and (b) received the said goods.
B. On June 20, 2015, around 04:57, the Defendant presented the victim B’s national physical fitness card that acquired the user fee of KRW 9,000 from F in Gyeyang-si E, Yangsan-si, and had the victim prepare a bank physical fitness slip and made a false signature thereon, and used the above F.
C. On June 20, 2015, from around 05:24 to the same day, the Defendant purchased goods equivalent to KRW 102,300 from the H convenience store located in Yangsan City to the H convenience store located in G on the same day, and had the victim obtain a false signature by presenting the victim B’s national physical check card, and then having the victim issue a bank physical card sales slip, and received the said goods.
On June 20, 2015, the Defendant purchased goods of an amount equivalent to 61,500 won from J convenience points located in Yangsi-si I on the same day from around 05:41, 05 to the same day, and had the victim prepare a bank postal card and put a false signature on it, and received the above goods.
3. On June 29, 2015, the Defendant who entered a residence may steal money and valuables by using the cresh described in the main room in the “L” restaurant located in the Busan Dong-gu, Busan, in order to make the victims Mack.
