Reasons
Punishment of the crime
On June 19, 2015, the defendant was sentenced to a suspended sentence of two years for any similar rape in Busan District Court, and three years for a suspended sentence.
9. 25. The judgment became final and conclusive, but the sentence of the above suspended sentence was revoked on August 22, 2016, and the sentence was being executed in Busan detention center.

1. Around 23:00 on July 25, 2016, the Defendant: (a) obtained one copy of the national bank check (F) in the name of the victim E in front of the “D” located in the Busan Seo-gu, Busan; (b) but did not follow necessary procedures, such as returning it to the victim; and (c) embezzled as he/she had his/her idea to have.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. On July 26, 2016, around 01:04, the Defendant provided food equivalent to KRW 17,000, such as fins and fins, at the H restaurant located in Busan Seo-gu G, and had the victim, who was unable to know the business owner’s name at the same time in settling the food price, presented one copy of the above national bank finsing card in the name of E obtained as if he had a legitimate right to use, and signed and issued the sales slip to the victim.
Accordingly, the defendant uses lost credit cards, deceiving the victim, and received property from the victim.
B. On July 26, 2016, at around 01:19, the Defendant received 208 rooms from the victim J, a business owner of the franchise located in the Busan Seo-gu, Busan, and settled 40,000 won of the accommodation expenses, and presented one copy of the above E’s physical card from the national bank under the name of the Defendant, as if there was a legitimate right to use, and signed and issued the sales slip to the victim.
Accordingly, the defendant used lost credit cards and received property benefits from the victim by deceiving the victim.
C. The Defendant, at around 02:03 on the same day, was a business trip branch office with which the victim’s name cannot be identified in the above B/L room 208 room.
