A defendant shall be punished by imprisonment for two years.

The defendant is 220,00 won by fraud to C who is an applicant for compensation, and D who is an applicant for compensation.

[Criminal Power] On March 24, 2016, the Defendant was sentenced to two years of suspension of the execution of imprisonment with labor for fraud, etc. at the Seoul Central District Court, which became final and conclusive on April 1, 2016, and is currently under suspension of the execution.

【Criminal Facts】

On May 4, 2016, the Defendant posted a false statement to the effect that he/she sells Aphone 5S 32G mobile phones on the Internet NAVER car page, and that he/she would send a mobile phone when he/she deposits money to the victim K who reported and contacted with the posting.

However, the Defendant did not own the above mobile phone and did not have any intention or ability to send the above mobile phone as agreed even if he received the payment from the victim.

The Defendant, by deceiving the victim as above, received 233,00 won from the victim as the mobile phone price.

The Defendant, including that, from that time until May 18, 2016, obtained a total of KRW 2,728,000 as the price for goods from victims over 12 times in total, as shown in the attached Table 1 of Crimes List 1.

around May 10, 2016, the Defendant posted a letter to the effect that “The Defendant would send Aphone 5S 32G mobile phones to the victim who reported and sent it to the same effect, even if the Defendant did not intend to sell the goods to the victim even if he received money from the victim L,” and that the Defendant made a false statement to the same effect as the victim who reported and sent it to the same effect.

As above, the Defendant, by deceiving the victims as above, received KRW 184,00 from the victim’s foreign exchange bank account under the name of the Defendant on the same day, and from around that time to July 17, 2016, by deceiving the victims by the same method 68 times in total, as shown in attached Table 2, and received KRW 14,989,100 from the victims.
