As to the crime of fraud against the victim B, the defendant shall be punished by imprisonment with prison labor for not more than two months and the remainder of the judgment.

1. The criminal defendant against the victim B did not have the intent or ability to pay the price even if he/she received a game account from the victim B due to the lack of cash, etc.

Nevertheless, around October 25, 2017, the Defendant, at the Defendant’s house located in Nowon-gu in Seoul Special Metropolitan City, Seoul Special Metropolitan City, and the Defendant’s house, visited the victim who posted a notice to sell the game account by accessing “E”, a game item brokerage site, and selling the game account, and then sold the F Game account in cash with KRW 1.1 million on October 31, 2017, and then received from the victim the game account (G) worth KRW 1100,000 on the same day.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.

2. The Defendant had no intent or ability to create a game account even if he/she received a payment from the Victim H because the game account held by the Defendant was insufficient.

Nevertheless, at around 00:35, Apr. 21, 2018, the Defendant entered the Defendant’s house and posted a letter to purchase the game account by accessing “E”, a game item brokerage site, and then sold the F Game account at KRW 800,000,000,000. First, if sending KRW 400,000,000,000,000,000 won, it was transferred from the victim to the bank account (IJ) in the name of the Defendant.

Accordingly, the defendant was given property by deceiving the victim.
