A defendant shall be punished by imprisonment for a term of one year and three months.
3,100,000 won shall be additionally collected from the defendant.
Reasons
Punishment of the crime
1. Purchasing Metephopa (one philopopon; hereinafter referred to as “philopon”) who is a medicine of a psychotropic spirit;
A. On October 2015, the Defendant purchased philophones by using 1.5 million won in cash and 3g philophones in front of the construction site located in Gyeong-si, Gyeong-si, Gyeong-si, Gyeong-si.
B. On March 2016, the Defendant purchased phiphonephones by giving KRW 1.5 million in cash to D and receiving approximately three grams of phiphonephones from F street in Daegu Northern-gu E around the middle wall of March 2016.
2. Sale of philophones;
A. On October 2015, the Defendant: (a) received KRW 1.5 million in cash from G in the street room located in the city of permanent residence in North Korea (the same day as the above 1-A); and (b) sold philopon to G in a manner of making up three grams of philopon purchased from D, such as the foregoing 1-A.
B. On March 23, 2016, the Defendant: (a) contained three grams of philophonephones purchased from D in three for a day-to-day mobile phone; (b) sent them to G via the Defendant’s home-to-door bus transport services; and (c) sold philophones by receiving KRW 1.5 million of the purchase price of the philophones sent by G through the Defendant’s home-to-face bus freight services in Seoul Hask-to-on Seoul Hask-si, Seoul Hask-si, Seoul Hask-si, and around the same day, sold philophones by receiving KRW 1.5 million of the purchase price of the philophones.
3. Smoking in writing or marijuana;
A. On December 2, 2015, the Defendant: (a) administered opphones by inserting approximately 0.08g of opphones into tobacco at the accommodation of the livestock farm operated by the Defendant located in the Gyeongbuk-do, the date of which December 2015, and administered opphones in a way that the smoke generated by attaching the fopon to tobacco; and (b) smokes marijuana.
B. On April 18, 2016, around 22:00, the Defendant administered phiphones by inserting approximately 0.08 grams of oponon and the marithic quantity of marijuana (one minute) into tobacco at the accommodation of the instant livestock farm, and smoking marijuana.
