Defendant shall be punished by a fine of three million won.

If the defendant fails to pay the above fine, 50,000 won shall be one day.

Punishment of the crime

Around August 25, 2013, the Defendant sent a false message stating that “The Victim B, on the Internet’s medium- and high-speed 4G mobile phone bulletin, posted a statement to the effect that “The Victim B would buy a HTS 4G mobile phone,” and the Defendant sent a false message to the Victim via the Mobile phone Kakao Kakao Stockholm, which read that “The Victim reported and contacted, and remitted KRW 23,000 to the account of community credit cooperatives (Account Number: C).”

However, the defendant did not have the above mobile phone at the time and did not have the intention or ability to send the mobile phone even if he received money from the victim.

As above, the Defendant, by deceiving the victim as above, received 23,000 won from the victim as the purchase price for mobile phones and acquired it by fraud.

The defendant of "2014 High 1489" was unable to express his/her intent or ability to sell goods on the Internet, and the same year from July 10, 2013.

9. 12.경까지 사이에 서울 광진구 자양4동 소재 PC방에서, 인터넷 네이버 중고나라 카페에 접속하여 '허벌라이프의 허브티를 각각 3만 원에 팝니다', ‘중고 아이팟 터치 3세대를 판매한다’, ‘중고 MP3를 판매한다’라는 등의 글을 게시하고 있던 중 피해자 D이 구매의사를 밝히자 물품대금을 피고인 명의 새마을금고 계좌(계좌번호: C)로 먼저 입금해 주면 물품을 배송해 주겠다고 거짓말을 하여 이에 속은 피해자 D으로부터 60,000원을 송금받은 것을 비롯하여 별지 범죄일람표 기재와 같이 피해자 8명을 기망하여 이에 속은 피해자들로부터 합계 399,000원을 송금받아 이를 편취하였다.
