A defendant shall be punished by imprisonment for a term of one year and two months.

The defendant is an applicant for compensation of KRW 50,000, which is obtained by deceit to E who is the applicant for compensation.

Punishment of the crime

Around February 15, 2013, the Defendant reported that “2013 Highest 2797” had access to the Internet portal site on the Internet portal bulletin board and posted a notice to the effect that he/she would wish to purchase a heavy mobile phone, and that he/she would send money to the victim’s bank, and that he/she would contact with the victim and send the mobile phone at his/her home.

However, even if the victim receives money from the victim as the price for the mobile phone, there was no intention and ability to send the mobile phone to the victim.

The Defendant, as such, by deceiving the victim, received 550,000 won in total from the victim, under the pretext of the victim’s heavy and mobile phone price, and received 19,582,000 won in total from the time to June 9, 2013, as shown in the crime sight table (1).

Around May 16, 2013, the Defendant sent a false statement to the effect that he/she would have access to the Internet portal website’s bulletin board and want to purchase a heavy and high-ranking camera, and that he/she would return money to the victim’s home-to-house in contact with the victim.

However, even if the victim receives money from the victim under the name of the Kameras, there was no intention and ability to send the Kameras to the victim.

The Defendant, as such, by deceiving the victim and receiving KRW 555,00 from the victim as the carmeras price, received total of KRW 2,760,000 from the victim until May 22, 2013, the Defendant received total of KRW 2,760,000 from the victim, as shown in the annexed Crime List (2).

"2013 Highest 2897" Defendant was connected to the bulletin board of the Internet SLR club at the PC room located in the irregular area of the Government around May 20, 2013.
