A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

At around 22:00 on May 10, 2016, the Defendant first known that “E” was a victim F (n, 14 years of age) and holding-out of “E” in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, Da302, and that it was difficult for the victim to sleep out by leaving-out, and that it was a situation in which the victim did not have a well-known place, the Defendant had the victim feel mind of having sexual intercourse with the victim by inducing the victim at home, and had the victim do so without any conditions, and had the victim find the address as the Defendant’s home.

At around 01:00 on May 11, 2016, the Defendant accumulated the gap in which the victim locked at the inside and outside of the Defendant’s house, thereby gathering the victim’s sexual organ on the side of another victim’s kacking the victim’s chest, her chest, and refused by the victim’s knifeing the Defendant’s hand, but, despite the victim’s refusal to do so, “if there is anywhere the male heading his knife at his knife at his knife,” and divided the victim’s knife by hand the part of the victim’s knife, and her reflects the victim’s sexual organ into the part of the victim’s sexual organ, and rape the victim who is a child or juvenile.

B. At around 02:00 to 03:00 on May 11, 2016, the Defendant committed an indecent act against the victim, who is a child or juvenile, by forcing the victim, to use his/her own sexual organ in the victim’s body, even though the victim refused to do so, in a situation where it is difficult for the victim to resist, and by forcing him/her to do so.
