A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Crimes against the victim B;

(a) No person shall photograph another person's body against his/her will, using a camera or any other mechanical device equipped with similar functions, which may cause sexual humiliation or sense of shame;

On September 9, 2018, at around 08:26, the Defendant, in Songpa-gu Seoul, taken the chests of the Victim B (V, 28 years of age), who was locked with the Defendant, using the Defendant’s cell phone camera function, and taken the Defendant’s chests of the victim.

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame against his will.

B.
