A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person shall photograph the body of another person against his/her will, using a camera or other mechanical device with similar functions, which may cause sexual humiliation or sense of shame;

Nevertheless, at around 23:54 on April 7, 2016, the Defendant taken the body of the victims who could cause sexual humiliation or sense of shame at 19 times in total, as shown in the attached list of crimes, from that time until April 27, 2018, including taking the shower by using the Defendant’s mobile phone screen recording function of the victim B, who was at the time when the Defendant took the shower by using the Defendant’s cell phone screen recording function.

2. 성폭력범죄의처벌등에관한특례법위반(카메라등이용촬영), 성폭력범죄의처벌등에관한특례법위반(성적목적다중이용장소침입) 피고인은 2018. 7. 12. 00:15경 경기 성남시 중원구 C건물 1층 여자화장실에서, 피해자 D(가명)이 용변을 보기 위해서 화장실로 들어가는 것을 발견하고 피해자를 따라 화장실로 안으로 들어간 다음, 피해자가 용변칸으로 들어가자 옆에 설치된 세면대를 밟고 올라가 칸막이 위를 통해 피고인의 휴대폰을 들이밀고 동영상 촬영 기능을 이용하여 하의와 속옷을 내리고 용변기에 앉아 용변을 보는 피해자의 모습을 촬영하였으나, 알 수 없는 이유로 피해자의 모습이 나타나지 않은 채 화면이 까맣게 나오는 동영상만을 촬영하여 그 뜻을 이루지 못하였다.
