Punishment of the crime

1. 공무집행방해 피고인은 2012. 12. 15. 01:45경 서울 강남구 B 앞 노상에서 친형인 C이 술에 취한 상태에서 운행하는 D 제네시스 승용차에 동승하여 가던 중 음주사실에 대해 112신고를 받고 출동한 서울강남경찰서 E지구대 소속 경사 F과 순경 G이 위 차량을 정차시키고 C에 대해 음주측정을 하려 하자 차에서 내려 경사 F에게 “야이 씨발 개새끼들 우리가 누군지 아느냐 이런 짭새 새끼들 죽여버린다”라고 욕설을 하며 어깨로 경사 F을 밀고 손으로 경사 F의 근무복 어깨 부위에 부착된 계급장을 잡아 당겨 뜯은 후 주먹으로 경사 F의 가슴을 쳐 바닥에 넘어뜨렸다.

Accordingly, the defendant interfered with the legitimate execution of duties concerning the drinking control of a slope F, a police officer.

2. 공용물건손상 피고인은 제1항 일시경 서울 강남구 E지구대에서 위와 같은 공무집행방해 혐의로 현행범 체포되어 대기하던 중 소내 경찰공무원들에게 “야 이 씨발 새끼들아 다 죽여버린다, 이 짭새 새끼들 내가 누군지 아느냐”라고 욕설을 하며 E지구대 내에 놓여 있던 가로 150cm, 세로 50cm 크기의 탁자를 수차례 발로 밟아 위 탁자를 부서지게 하였다.
