1. 공무집행방해 피고인은 2012. 6. 14. 14:25경 사천시 B에 있는 사천경찰서 C파출소에 찾아가 그전에 위 파출소 소속 경찰관들에 의하여 벌금 미납 수배 중 검거된 일 및 파출소 앞 도로를 자신의 경운기로 막아 일반교통방해죄로 입건된 일 등을 따지던 중 그곳 안내대 위에 있는 상황근무일지 받침을 밀치고, 의자를 잡아 밀면서 심한 욕설과 함께 상황 근무 중인 경찰관 경사 D에게 “야이 호로새끼들아. 너희들 벌금 매기는데 재미 붙였나. 의자로 대갈통을 깨 부숴버리겠다. 이 미제 앞잡이 새끼들아. 왜 나한테 벌금을 매기는데. 삼족을 총살시켜버리고 재산을 몰수해 버리겠다.”는 취지로 협박하여 경찰관의 치안유지에 관한 정당한 직무집행을 방해하였다.

2.
