Defendants shall be punished by a fine of KRW 1,000,000.

In the event that the Defendants did not pay the above fine, each of them is 100.

Punishment of the crime

From November 2014, the Defendants are operating the mutual clothes selling company of 506 "E" in Seoul Jung-gu Seoul, Jung-gu.

피고인들은 공모하여, 2015. 1.경 위 주소지에서 상표권자 ‘가부시끼가이샤고모데갸루쏭’의 등록상표인 ‘COMME des GARCONS HOMME'(상표등록번호 제319465호), ’톰브라운인코포레이티드‘의 등록상표인 ’THOMBROWNE'(상표등록번호 제024637호)와 동일한 위조 상표가 부착된 시가 합계 1,704,115원 상당의 의류 16점을 보관하던 중 이를 판매한 것을 비롯하여 2015. 7.경까지 별지 범죄일람표 (1) 기재와 같이 7가지 브랜드의 위조 상표가 부착된 시가 합계 21,487,705원 상당의 의류 299점을 소지하던 중 이를 판매하고, 2015. 7. 8. 14:30경 위 주소지에서 상표권자 ‘몽클레어에스.알.엘’의 등록상표인 ‘MONCLER'(상표등록번호 제373377호)와 동일한 모양의 위조 상표가 부착된 시가 합계 360,000원 상당의 점퍼 3점을 비롯하여 별지 범죄일람표 (2) 기재와 같이 9가지 브랜드의 위조 상표가 부착된 시가 합계 1,718,000원 상당의 상품 55점을 판매하기 위해 소지하여 상표권을 각각 침해하였다.
