When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

From January 2015, the Defendant is a person who sells mobile phone cases via the Internet in the name of “C” in Incheon Dong-gu B house 302 from January 2015.

피고인은 2015. 1.경 위 주소지에서 상표권자 ‘루이비똥 말리띠에’의 등록상표인 ‘LOUIS VUITTON'(상표등록번호 제631194호), ’구치오구치쏘시에떼퍼아찌오니‘의 등록상표인 ’GUCCI'(상표등록번호 제912201호), ‘샤넬’의 등록상표인 ‘CHANEL'(상표등록번호 제055592호)와 동일한 모양의 위조 상표가 부착된 시가 합계 1,265,000원 상당의 휴대폰케이스 31개를 보관하던 중 이를 판매한 것을 비롯하여 2015. 5.경까지 별지 범죄일람표(1) 기재와 같이 3가지 브랜드의 위조 상표가 부착된 시가 합계 4,597,500원 상당의 휴대폰케이스 118개를 소지하던 중 이를 판매하고, 같은 달 12. 16:00경 위 주소지에서 별지 범죄일람표(2) 기재와 같이 상표권자 ’루이비똥 말리띠에‘의 등록상표인 ‘LOUIS VUITTON'(상표등록번호 제631194호)과 동일한 모양의 위조 상표가 부착된 휴대폰케이스 74점(판매시가 1,480,000원), ’구치오구치쏘시에떼퍼아찌오니‘의 등록상표인 ’GUCCI'(상표등록번호 제912201호)와 동일한 모양의 위조 상표가 부착된 휴대폰케이스 26점(판매시가 520,000원), ‘샤넬’의 등록상표인 ‘CHANEL'(상표등록번호 제055592호)과 동일한 모양의 위조 상표가 부착된 휴대폰케이스 12점(판매시가 240,000원) 등 총 112점의 상품(판매시가 합계2,240,000원)을 판매하기 위해 소지하여 상표권을 침해하였다.
