Defendant
A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of ten months.
provided that this judgment has become final and conclusive.

Punishment of the crime
Defendant
A is a person who manufactures and sells goods with a false-known trademark (hereinafter referred to as “representative”) in the warehouse and keeps the same in custody as the manager and manager of the goods with a false-known trademark, and the defendant B is a person who manufactures and delivers the same as the manager and manager of the factory at the request of the defendant A.
1. Defendant A
A. (1) In violation of the Trademark Act (1) from December 2012 to June 19, 2013, Defendant A violated the trademark rights of the said trademark right holder by manufacturing 900 points on which a trademark of the same shape as “LOUS VITON” (trademark number No. 059471) is attached to a factory located on the first floor of D underground from Gwanak-gu in Seoul Special Metropolitan City, Seoul, and at a factory located on the first floor of the underground of Dongjak-gu Seoul, Dongjak-gu, Seoul, (hereinafter “LOUS VITON”), which is the registered trademark of the trademark right holder, “LOUS VITON” (trademark number No. 059471), and 300 points on wall A (a total of KRW 210 million at the estimated market price of goods).
(2) 피고인 A은 2013. 6. 19.경 위 E에 있는 지하 1층 공장에서 상표권자 ‘샤넬’의 등록상표인 ‘CHANEL'(상표등록번호 제071324호)과 동일한 모양의 위조 상표가 부착된 가방 7점(정품추정시가 합계 3,990만 원 상당), 상표권자 ‘엠체엠홀딩아게’의 등록상표인 ‘MCM'(상표등록번호 제148830호)과 동일한 모양의 위조 상표가 부착된 가방 4점(정품추정시가 합계 200만 원 상당), 상표권자 ‘프라다. 에스. 에이.’의 등록상표인 ‘PRADA'(상표등록번호 제350206호)와 동일한 모양의 위조 상표가 부착된 가방 2점(정품추정시가 합계 980만 원 상당)을 판매할 목적으로 보관함으로써 위 상표권자들의 상표권을 각각 침해하였다.
(3) On June 19, 2013, Defendant A: (a) around 19, 2013, attached a forged trademark of the same shape as “LOUIS VITON” (trademark registration number No. 059471); and (b) around 230,000, the estimated price of the household items 1,325, on which the trademark of the same shape is attached to the trademark holder at the warehouse kept by the manager of the Geumcheon-gu Seoul Metropolitan Government.
