Defendants shall be punished by a fine of KRW 1,000,000.

In the event that the Defendants did not pay the above fine, each of them is 100.

Punishment of the crime

It is necessary to revise and supplement part of the facts charged without following the amendment of indictment to the extent that it seems that there is no concern about actual disadvantage to the defendants' defense right.

1. Defendant A is a person who operates a female clothing store under the trade name of Songpa-gu Seoul Metropolitan Government 1st floor No. 49.

At around 13:30 on April 7, 2015, the Defendant infringed on the trademark right by possessing a total of 11 points (total market price of 415,00 won) with a trademark of the same shape as the trademark of “BURY” (No. 0497230 of the trademark registration number) as the trademark of “BURRY” (No. 0497230 of the trademark registration number) at the above clothing store, as shown in the attached list of crimes.

2. Defendant B is a person who operates a female clothing store with the trade name of “F” in Songpa-gu Seoul Metropolitan Government 1st floor 62.

피고인은 2015. 4. 7. 13:30경 위 의류점에서 상표권자 ‘샤넬’의 등록상표인 ‘CHANEL'(상표등록번호 제0055592호)과 동일한 모양의 위조 상표가 부착된 자켓 1점(판매시가 미상), 상표권자 ’프라다 에스.에이’의 등록상표인 ‘PRADA'(상표등록번호 제0434504호)와 동일한 모양의 위조 상표가 부착된 티셔츠 1점(판매시가 미상)을 판매하기 위해 소지하여 상표권을 침해하였다.

3. Defendant C is a person who operates a female clothing store under the trade name of “G” in Songpa-gu Seoul Metropolitan Government 1st floor 50.

On April 13:30, 2015, the Defendant infringed on the trademark right by possessing one set (80,000 won at the selling price) of the co-art with the same shape as the registered trademark "BURY" (No. 0497230 of the trademark registration number) at the above clothing store.
