1. The Defendants jointly share KRW 13,786,605 to the Plaintiffs, as well as their annual interest from February 21, 2017 to November 20, 2018.
Reasons
1. Determination as to the cause of claim
(a)The following facts may be found either in dispute between the Parties or in addition to the purport of the entire pleadings, either in Gap evidence Nos. 1, 5, 6, and 13 (including paper numbers):
(1) On February 3, 2016, the Plaintiffs concluded a lease agreement (hereinafter “the lease in this case”) with regard to the six-story above 330.6 square meters in Seocho-gu Seoul Metropolitan Government F, Seocho-gu, and six-story 157.18 square meters in 2 underground floors among the buildings owned by the Defendants and the Plaintiffs (hereinafter “instant real estate”), setting the lease term from February 18, 2016 to February 17, 2018, KRW 30,000 in lease deposit, KRW 3,413,00 in rent (including management expenses, separate surtax), and the 24th day of each month in which the date of payment was due.
(2) The Defendants paid the lease deposit to the Plaintiffs, and used the instant real estate as the office on February 18, 2016.
(3) On September 17, 2016, the Defendants did not pay rent of KRW 3,850,000 in addition to paying rent of KRW 3,850,000. On November 28, 2016, the Plaintiffs sent to the Defendants a notice that the lease will be terminated as of December 11, 2016 without a separate peremptory notice if the Defendants failed to pay the unpaid rent and management expenses.
(4) On December 27, 2016, the Defendants delivered the instant real estate to the Plaintiffs.
Although the Plaintiffs asserted on January 18, 2017 as the date of the completion of delivery, it is reasonable to regard December 27, 2016 as the delivery date that the Defendants notified the Plaintiffs to the administrator of the instant real estate.
(5) The instant lease agreement includes the following:
Article 3 (1) A lessee shall be free of the name of the tenant, such as rent every month (including management expenses and value added tax), water supply charges, public charges and public charges imposed on the leased object, cleaning expenses for septic tanks, cleaning expenses for buildings, outer walls and glass cleaning expenses, disinfection expenses, environmental improvement expenses for facilities, charges for causing traffic congestion, outdoor signboard permission expenses, urban gas inspection expenses, fire-fighting inspection expenses, and incidental expenses.
