(b) Possibility of the declaration;

In full view of the timing and place of each demonstration, the size of the demonstration such as the number of participants, the movement route of the demonstration unit, the detailed form and conditions of the demonstration at the time, the deliberation of the road traffic level at the time, the road traffic volume and the traffic situation at the time, etc., it is insufficient to recognize that the evidence submitted by the prosecutor alone submitted by the above demonstration was insufficient, or that there was a danger to the extent that the daily traffic was impossible or significantly difficult, and there is no other evidence to prove otherwise.

3. Conclusion

Therefore, since this part of the facts charged falls under a case where there is no proof of crime, each not guilty should be pronounced pursuant to the latter part of Article 325 of the Criminal Procedure Act, or as long as it is found guilty of a violation of the Act on the Promotion of Outdoor Demonstration due to the holding of each report outdoor demonstration, which is in a mutually competitive relationship with the facts charged about general traffic obstruction, the judgment of innocence shall not be rendered separately in the disposition

It is so decided as per Disposition for the above reasons.
