A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Purchasing marijuana;
A. On June 18, 2014, the Defendant, along with C, remitted to the bank account in the name of D the sum of KRW 90,000,000 to KRW 3,70,000,000,000 to the bank account in the name of D. On June 18, 2014, D had D transfer the said KRW 4,60,000 to the Gwangju bank account in the name of E, and on June 19, 2014, the Defendant purchased the marijuana in collusion with C, by taking around 18:30 on June 19, 2014, from the Seoul High Bus Terminal located in Seocho-gu Seoul Metropolitan City, Seocho-gu 19-4.
B. Around June 21, 2014, the Defendant, along with F, had F transfer 4,50,000 won to the bank account in the name of D, and had D transfer 4,50,000 won, plus 10,000 won, to the bank account in the name of E, and around 20:05 on the same day, the Defendant purchased marijuana in collusion with F.
C. Around July 10, 2014, the Defendant, along with G and C, had G transfer KRW 450,000 and KRW 150,000,000 to the account in the name of Korea bank in the name of D. Around July 10, 2014, the Defendant: (a) had D transfer KRW 600,00 to the agricultural bank account in the name of H in the name of H used by E; and (b) purchased marijuana in collusion with L, G, and C at the above Seoul High Bus Terminal on the same day at around 20:30 on the same day.
On July 15, 2014, the Defendant remitted KRW 450,00 to the Korean bank account in the name of D, and then, D transferred KRW 600,000 to the Gwangju bank account in the name of E, plus KRW 150,000,000,000,000,000, and around 20:30 on the same day, the Defendant purchased marijuana by putting about KRW 47,00 from E from the Dong Seoul High Bus Terminal in Gwangjin-gu, Seoul Special Metropolitan City.
2. Smoking marijuana;
A. On June 19, 2014, the Defendant around 22:00, at the Defendant’s home located in Dongjak-gu Seoul Metropolitan Government I and 201, approximately 0.5g of marijuana, along with C.
