A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2014. 1. 15.경부터 2014. 6. 12.경까지 대전 유성구 C에 있는 ‘D’에서 ‘킹덤 포커’ 게임기 50대를 설치하여 놓고 그 곳을 찾은 불특정 다수의 손님으로 하여금 게임기에 현금을 투입하고 자동실행장치인 속칭 '똑딱이'를 이용하여 자동으로 게임을 진행하게 한 후, 우연에 의하여 5장의 서양카드 패의 조합에 의해 정해진 점수를 획득하게 하고, 점수를 획득한 손님들로부터 적립된 점수의 반환을 요구받으면 그 해당 점수를 점수보관 기능이 포함된 무기명 멤버쉽 카드에 입력하여 발행하여 주고 손님들 또는 제3자로부터 위 카드의 사용을 요구받으면 기재된 점수만큼 게임기에 입력해 주어 게임을 다시 할 수 있게 하거나 종업원 E을 통하여 위 점수의 20%를 수수료로 제한 나머지를 현금으로 환전하여 주었다.

As such, the Defendant, regardless of the game proprietor’s ability, automatically carried out a game product, issued a bearer electronic card with the value of monetary exchange with the points obtained by customers using the game product, or given the points in exchange for money, thereby allowing them to engage in gambling and other speculative acts, or neglecting to cause them to do so.
