A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. From December 2, 2015 to February 2016, the Defendant taken the body of the victim using a camera attached to a smartphone against the victim’s will, while having sexual intercourse with the victim E (V, 31 years of age) as set forth in subparagraph 206 of the D dormitory in Yanan-gu, Yanan-si, Yan-si, Seoul, from December 2015 to February 2016.

2. On July 5, 2016, the Defendant, at around 17:51 on July 5, 2016, accessed the victim’s name at the place indicated in paragraph (1) at around 17:51, and on the Internet site called “F,” and sent one copy of the photograph, one of the pictures taken under paragraph (1) at the victim’s friendship H’s F account for the victim’s friendship, in which the victim was aware of himself/herself.

As a result, the Defendant distributed photographs taken of the body of the victim who could cause sexual humiliation or shame by using camera or other similar devices, against the will of the victim.

3. On July 2016, the Defendant sent three copies of the pictures, such as the victim’s photograph, the victim’s chest, and sound photograph, which were taken under paragraph (1) to the FF account of the victim’s workplace, in the same manner as the facts constituting the crime described in paragraph (2), at the early Scandon Scandon (S) on July 2016.

As a result, the Defendant distributed photographs taken of the body of the victim who could cause sexual humiliation or shame by using camera or other similar devices, against the will of the victim.

4. On July 2016, the Defendant sent three copies of the images, such as the photo taken by the victim, the victim’s chest, the victim’s chest, and the negative photo, etc., to the victim’s workplace, using the same method as the criminal facts indicated in paragraph (2) of “F” at the end of July 2016.

Accordingly, the defendant has a camera or other similar function.
