Reasons
Punishment of the crime
1. Defendant A
A. A. Habitual gambling (1) the Defendant, along with three persons in E, F, and nameless boxes. From around 20:0 to around 07:00 on May 15, 2013, at the parking lot closure room located on the first floor of Yongsan-gu Seoul Metropolitan Government, the Defendant: (a) had four cards per capita using 52 cards; (b) had three-time cards; (c) had three-time cards changed; and (d) had three-time cards; and (e) in the case of a difference between the pattern of non-type and the number in four-day card finally possessed, the Defendant ambling several times by a person with the lowest number by comparing the largest number among them.
(2) On May 16, 2013, the Defendant, along with three persons of E, F, and nameless winners, carried out a “bagod” gambling in an amount equivalent to KRW 100 million in total, in several times, at the rest room in the parking lot located on the first floor in Yongsan-gu Seoul Metropolitan Government, from around 18:00 to 04:00 the following day.
(3) On June 17, 2013, from around 23:00 to around 08:00 the following day, the Defendant ambling “balls” worth KRW 30 million in total in several times in the manner, such as the foregoing (i) and (ii).
(4) On August 17, 2013, the Defendant, along with E, F, J, Sexual Incompetence “K”, “L”, “M”, and “N”, ranging from August 17, 2013 to October 10, 2013, carried out gambling at the office of the second floor of Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, with the same method as the above (1).
(5) The Defendant, along with E, F, J, P (Suspension of Prosecution on the same day), K on the same day, sex in secret, L, and Q from August 25, 2013 to October 25, 2013, carried out gambling in the office of the second floor of Dongdaemun-gu Seoul, Dongdaemun-gu, and in the same manner as the above (1) at a number of times as in paragraph (1).
(6) The Defendant together with E, F, and J, from August 26, 2013 to October 200 of the following day.
