The sentence of punishment against the Defendants shall be suspended.
Reasons
Punishment of the crime
Defendant
A is a practicing licensed real estate agent operating “E” in Ma and Da at the time of light, and Defendant B is a brokerage assistant of the above E.
No practicing licensed real estate agent, etc. (mediation assistant, etc.) shall engage in any transaction directly with the client.
Defendant
B purchased real estate while working in E, and posted it on the Internet, such as F real estate, in the name of “E” operated by Defendant A with the consent of Defendant A, and make direct transactions with the client who reported and contacted it. Defendant A prepared a real estate sales contract and received a brokerage commission from the client if the client visits.
1. Around January 9, 2018, Defendant B posted a notice in the name of “E” on the Internet, such as the F real estate in light-to-de G building H, Defendant B, the ownership of Defendant B, and the client I who reported and contacted the notice to the broker I would be the licensed real estate agent office. Defendant A prepared a sales contract for the said real estate with the purchase price of KRW 236,000,000, seller B, and buyer I, and the broker I received KRW 1,60,000,000 from the broker I.
As a result, the Defendants conspired to make direct transactions with the client.
2. Defendant B, around August 10, 2018, posted the notice in the name of “E” on the Internet, including F real estate, J Apartment-si, the Defendant B owned, in the name of “E”, and reported and contacted the notice to the broker L as a licensed real estate agent office. Defendant A prepared a sales contract for the said real estate with the purchase price of KRW 246,00,000, seller B, and L as the buyer. Defendant A received KRW 10,100,000 from the client L.
As a result, the Defendants conspired to make direct transactions with the client.
