Defendants shall be punished by a fine of 2.5 million won.

If the Defendants did not pay the above fine, 100,000 won.

Punishment of the crime

1. Defendant A and Defendant B’s conspiracy Defendant B are practicing licensed real estate agents having established the D Licensed Real Estate Agent Office located in Ulsan-gun, Ulsan-gun, Ulsan-do around August 2, 2012, and Defendant A is registered as a broker assistant of the said office.

No practicing licensed real estate agent, licensed real estate agent affiliated with a broker, brokerage assistant, etc. shall conduct direct transactions with the client or represent both of the transaction parties.

Nevertheless, on January 22, 2016, the Defendants conspired to make direct transactions with the clients, and Defendant B sold the land of Ulsan-gun E, Ulsan-gun, Defendant A at the said office to F (State). On May 16, 2016, the Defendants purchased the land of Ulsan-gun, Ulsan-gun G from H in the name of Defendant A in the name of the said office, and made direct transactions with the clients two times.

2. Defendant A is a practicing licensed real estate agent having the D Licensed Real Estate Agent Office located in Ulsan-gun C around August 29, 2017, and Defendant A is a person registered as a broker assistant to the said office.

No practicing licensed real estate agent, licensed real estate agent affiliated with a broker, brokerage assistant, etc. shall conduct direct transactions with the client or represent both of the transaction parties.

Nevertheless, the Defendant and I made direct transactions with the clients, and I conspired to intermediate them, and around December 3, 2018, sold the G land owned by the Defendant A to the J in Ulsan-gun, Ulsan-gun, and made direct transactions with the clients.

3. No practicing licensed real estate agent who runs the brokerage business without the registration of establishment of his/her brokerage office shall receive a request for brokerage or allow him/her to use his/her name, knowing that he/she is the person who runs the brokerage business;

Nevertheless, on August 2, 2012, the Defendant established the D Licensed Real Estate Agent Office in Ulsan-gun C in the name of the Defendant.
